These Terms of Use ("Terms") govern your use of https://kitchentrashcans.com (the "Site"). The Site is operated by X Enterprises, LLC, 18122 3rd Dr SE, Bothell, WA 98012 ("we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
What the Site is, and what it is not
The Site publishes general information about kitchen trash cans: step, touchless, pull-out, under-sink, and dual cans, sizes and bag fit, materials, children and pets around the trash, cleaning, odor, fruit flies, house flies, roaches and mice, recycling, recycling symbols, composting, and batteries. We are not a retailer, a brand, a maker, an installer, a pest control company, a testing laboratory, a government agency, a poison center, a medical or veterinary provider, or a lawyer. We do not sell trash cans, bags, cleaners, or any other product. The Site does not give prices, product picks, capacity recommendations, cleaner recipes or dilutions, pesticide products or application steps, or installation, repair, or battery-change steps.
Important kitchen and household safety notice
Kitchen trash can hold spoiled food, sharp objects, batteries, and plastic bags. Plastic bags can suffocate children. Button and coin batteries can cause severe injury or death if swallowed. Cleaning and disinfecting products can cause serious harm if swallowed, breathed in, splashed, or mixed, and pesticides can harm people and pets. You are responsible for how you choose, use, clean, place, and dispose of any can, bag, cleaner, battery, trap, bait, or pesticide, for following the product label and the maker's manual and instructions, and for keeping children and pets away from hazards. If someone may have swallowed something harmful, call Poison Help at 1-800-222-1222. In an emergency, call 911.
General information only; no professional, legal, medical, or safety advice
Content on the Site is for general information. It is not legal, regulatory, medical, veterinary, pest control, safety, or professional advice, and it is not a substitute for a product label, the maker's manual, a poison center, your doctor, your veterinarian, a licensed pest control professional, your local recycling or solid waste program, or a qualified professional. We do not say that any can, bag, cleaner, battery, trap, bait, or practice is safe, and nothing on the Site is a safety inspection, test, or certification.
Children, pets, and household hazards
Where the Site describes guidance from the American Academy of Pediatrics, the FDA, the CDC, EPA, HRSA's Poison Help, or the National Capital Poison Center, it does so as general information, in their words. Words such as "child-resistant cover" are the source's words for a goal, not a rating or certification we give any product. We do not call any can child-proof, child-resistant, pet-proof, or dog-proof. You decide how to store trash, bags, batteries, and cleaners in your home, and you are responsible for supervising the children and pets in your care.
Cleaning and disinfecting products
The Site does not give cleaner recipes, mixing instructions, or bleach or disinfectant dilutions. Where it describes cleaning, sanitizing, or disinfecting, it does so as the CDC or EPA states it. Follow the label of every product you use, including its directions, protective equipment, ventilation, contact time, storage, and disposal. Never mix cleaning or disinfecting products with each other.
Batteries
The Site does not give battery-change, charging, or repair steps. Where it describes battery disposal, it does so as EPA states it, by battery type. Follow the maker's manual for any battery-powered can, the markings on each battery, and your local or state rules for battery disposal and recycling.
Pests and pesticides
The Site does not name pesticide products or give application steps. Where it describes pest prevention, traps, or bait stations, it does so as EPA or a university extension service states it. If you use a pesticide, read and follow its label. If you hire a pest control professional, that is between you and them. Nothing on the Site says that any can, lid, bag, or practice keeps pests away.
Recycling, composting, and environmental claims
Where the Site describes recycling and composting, or the FTC's Guides for the Use of Environmental Marketing Claims (16 CFR Part 260, the "Green Guides"), it does so as EPA, the FTC, or the eCFR state them, for general information only. The Site makes no environmental claim about any product, and it does not say that any can, bag, or liner is recyclable, compostable, biodegradable, degradable, or made from recycled material. Local recycling and composting programs set their own rules. The Green Guides and other federal, state, and local laws may apply to sellers and marketers. If you make, label, or sell products, read the current rules and get advice from a qualified professional about your situation.
Makers' manuals and instructions
Trash cans, liners, bags, cleaners, deodorizers, batteries, traps, baits, and accessories are made and sold by third parties under their own terms. Their labels, manuals, instructions, and warnings control over anything on the Site. We have not tested any product. We are not responsible for any third party's products, labels, manuals, instructions, or recalls.
Agencies, organizations, and sources
Government agencies, medical associations, poison centers, and universities named on the Site, including the CDC, EPA, the FTC, NIST, the FDA, HRSA, the American Academy of Pediatrics, the National Capital Poison Center, and university extension services, are credited for their own guidance and definitions. They do not endorse the Site, and the Site's mention of a source or rule is not a statement that any product is approved, certified, compliant, or safe.
The Site name
"Kitchen Trash Cans" is the name of the Site. It is not a store, and it is not a claim about any product.
Brand names and trademarks
Brand, product, program, and organization names mentioned on the Site belong to their owners. We use them only to credit their own guidance. The Site is not affiliated with, sponsored by, or endorsed by any brand or organization it mentions.
Affiliate links
Some links may be affiliate links. We may earn a commission if you buy through them, at no extra cost to you. Any purchase is between you and the retailer, under the retailer's terms. See our Affiliate Disclosure.
Eligibility
The Site is for a general audience. It is not directed to children under 13.
Acceptable use
You agree not to:
- use the Site in violation of any law;
- copy, scrape, or republish Site content in bulk without our written permission;
- interfere with, overload, or attempt to gain unauthorized access to the Site.
Intellectual property
Site content, design, and text are owned by us or our licensors and are protected by law. You may view and share links to the Site for personal, non-commercial use. Third-party names and trademarks are covered under "Brand names and trademarks" above.
Third-party websites
Links to retailers, makers, government agencies, medical associations, poison centers, universities, and other websites are provided for convenience. We do not control those sites and are not responsible for their content, products, prices, or policies.
Disclaimer of warranties
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, ANY PURCHASE FROM A THIRD PARTY, OR THE USE, STORAGE, OR DISPOSAL OF ANY TRASH CAN, BAG, CLEANER, DISINFECTANT, BATTERY, TRAP, BAIT, PESTICIDE, OR OTHER PRODUCT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED.
Indemnification
You will defend, indemnify, and hold us harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms.
Dispute resolution; binding arbitration; class-action waiver
Please read this section carefully. Except for small-claims matters and claims for injunctive relief over intellectual property, any dispute about these Terms or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat of arbitration will be King County, Washington, unless you and we agree otherwise. You and we waive any right to a jury trial and to take part in a class, consolidated, or representative action. If the class-action waiver is found unenforceable for a claim, that claim must proceed in court and not in arbitration.
Governing law and venue
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Subject to the arbitration section, exclusive venue for permitted court actions is the state or federal courts in King County, Washington, and you consent to jurisdiction there.
Assignment and change of operator
We may assign or transfer these Terms, and the Site, to a successor operator, including as part of a sale of the Site, without notice to you. After that, the successor operator takes our place under these Terms and may post its own terms. You may not assign these Terms without our written consent.
Changes
We may update these Terms by posting a revised version on this page with a new "Last updated" date. Continued use after that date means you accept the revised Terms.
Miscellaneous
These Terms, with the Privacy Policy and Affiliate Disclosure, are the entire agreement between you and us about the Site. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver.
